The iOS App Terms of Use adjusts and\/or supplements certain terms of the Agreement, solely with respect to the App. Capitalized terms used but not defined in the iOS App Terms of Use have the meanings given to them in the Agreement.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9863531 elementor-widget elementor-widget-text-editor\" data-id=\"9863531\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The App contains a feature that allows a Customer User to unlock premium access if User has a valid and active subscription.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d9fc038 elementor-widget elementor-widget-text-editor\" data-id=\"d9fc038\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Apple Inc. may, at any time and without notice, restrict, interrupt, or prevent use of the App, or delete the App from your or Customer&#8217;s Apple device(s), or require the owner to do any of the foregoing, without entitling Customer or you to any refund, credit, or other compensation from the owner or any third party (including, but not limited to, Apple Inc. or your network connectivity provider).<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f88f7a5 elementor-widget elementor-widget-text-editor\" data-id=\"f88f7a5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tThe iOS App Terms of Use was last updated on 1 September 2022 (\u201cVersion Effective Date\u201d). It is effective between you and PokerDealer as of the date you first download, install, or use the App, whichever occurs earliest and can be accessed and downloaded at: <a title=\"Poker Dealer iOS terms of use\" href=\"https:\/\/pokerdealer.app\/index.php\/terms-of-use\/\" target=\"_blank\" rel=\"noopener\">https:\/\/pokerdealer.app\/index.php\/terms-of-use\/<\/a>. The owner may update and change any part or all of the iOS App Terms of Use. The updated version will be posted publicly on PokerDealer\u2019s website at the above link and will be effective and binding on the day after posting. PokerDealer encourages Customer and Users to review the iOS App Terms of Use periodically, as you are responsible for reading and complying with any amended version(s). If Customer or User objects to any such changes, Customer\u2019s or User\u2019s sole recourse shall be to cease using the App. Continued use of the App following the relevant Version Effective Date shall indicate Customer&#8217;s and User\u2019s acknowledgement of such changes and agreement to be bound by the updated iOS App Terms of Use.\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8585509 elementor-widget elementor-widget-text-editor\" data-id=\"8585509\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>You acknowledge and agree to PokerDealer\u2019s Privacy Policy, which can be accessed at: <a title=\"Legal: Privacy Policy\" href=\"https:\/\/pokerdealer.app\/index.php\/privacy-policy\/\" target=\"_blank\" rel=\"noopener\">https:\/\/pokerdealer.app\/index.php\/privacy-policy\/<\/a><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-7f0c8da\" data-id=\"7f0c8da\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2e7fbe3 elementor-section-boxed elementor-section-height-default elementor-section-height-default false\" data-id=\"2e7fbe3\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-b26eed8\" data-id=\"b26eed8\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-674523f\" data-id=\"674523f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d730240 false elementor-widget elementor-widget-heading\" data-id=\"d730240\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">License to use the app<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f8b51a9 elementor-widget elementor-widget-text-editor\" data-id=\"f8b51a9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tThe App is licensed, not sold, to Customer by PokerDealer through subscriptions (1 month, 6 months or 1 year auto-renewable subscription) only under the terms of the Agreement and PokerDealer reserves all rights not expressly granted to Customer.\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f70472 elementor-widget elementor-widget-text-editor\" data-id=\"6f70472\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Unless otherwise specified in the Agreement and subject to payment of the Subscription Fee and any other undisputed amounts due, PokerDealer grants to User, a limited, non-exclusive, non-assignable, non-transferable, renewable, and revocable license during the applicable Term, to access premium content and use the App on any Supported Device and on no other devices, exclusively for Customer\u2019s internal business purposes, as set out in the Agreement. The license granted to User and Customer for the App is a non-transferable license to use the App on any iOS devices that User owns or controls and as permitted by Apple (\u201cSupported Devices\u201d).<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5a0cd0 elementor-widget elementor-widget-text-editor\" data-id=\"f5a0cd0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tBy subscribing a PokerDealer auto-renewable plan, the User accepts the End User Licence Agreement that can be accessed at: <a href=\"https:\/\/www.apple.com\/legal\/internet-services\/itunes\/dev\/stdeula\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.apple.com\/legal\/internet-services\/itunes\/dev\/stdeula\/<\/a>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6fcc881 elementor-widget elementor-widget-text-editor\" data-id=\"6fcc881\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Such license permits you to use Intellectual Property Rights and Confidential Information included in the App. Such license shall not be construed to mean, by inference or otherwise, that Customer has any right to access or obtain any source code for the App.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-681febe elementor-widget elementor-widget-text-editor\" data-id=\"681febe\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Without limiting the generality of anything herein, Customer&nbsp;acknowledge and agree that the use of PokerDealer engages its own responsibility in accordance with the laws in force in its country concerning gambling. Customer does not enter into real money gambling in the App. The use made of the App engages Customer to play responsibly.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0fce6d2 elementor-widget elementor-widget-text-editor\" data-id=\"0fce6d2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Playing responsibly is all about knowing your limits and playing within your means. PokerDealer is intended to be a fun, low-cost form of entertainment.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-dd37e37\" data-id=\"dd37e37\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2072e65 elementor-section-boxed elementor-section-height-default elementor-section-height-default false\" data-id=\"2072e65\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-e7bd47e\" data-id=\"e7bd47e\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-2395adc\" data-id=\"2395adc\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d6e2e62 false elementor-widget elementor-widget-heading\" data-id=\"d6e2e62\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Apple terms<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9e4ef4d elementor-widget elementor-widget-text-editor\" data-id=\"9e4ef4d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>PokerDealer, and not Apple, is solely responsible for the App and the license granted herein. Apple has no obligation to provide maintenance and support for the App.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0cdf3a1 elementor-widget elementor-widget-text-editor\" data-id=\"0cdf3a1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\tUser\u2019s use of the App must comply with the Usage Rules set forth in the Apple App Store Terms of Use, which can be accessed and downloaded at: <a href=\"https:\/\/www.apple.com\/legal\/internet-services\/itunes\/us\/terms.html\">https:\/\/www.apple.com\/legal\/internet-services\/itunes\/us\/terms.html<\/a>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9500b1 elementor-widget elementor-widget-text-editor\" data-id=\"f9500b1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Apple is not responsible for addressing, investigating, defending, settling, or discharging any claim brought by Customer or any third party for allegations relating to the App, or your or Customer&#8217;s possession and\/or use of the App, including but not limited to: (a) product liability; (b) any failure of the App to comply with applicable legal or regulatory requirements; (c) consumer protection or similar legislation; or (d) infringement of third party intellectual property rights.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4b2a929 elementor-widget elementor-widget-text-editor\" data-id=\"4b2a929\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>As a User, you represent and warrant that: (a) the App will not be downloaded in, used in, or transported to a country that is subject to a U.S. Government embargo or EU government sanctions, or that has been designated by the U.S. Government or any EU government as a &#8220;terrorist-supporting&#8221; country or similar; and (b) neither Customer nor User is listed on any U.S. Government or EU government list of prohibited or restricted parties.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e8cceac elementor-widget elementor-widget-text-editor\" data-id=\"e8cceac\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Notwithstanding anything to the contrary in the Agreement, Apple and its subsidiaries are third-party beneficiaries of the iOS App Terms of Use, and have the right (and shall be deemed to have accepted the right) to enforce the iOS App Terms of Use against you and Customer.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-84e8485 elementor-widget elementor-widget-text-editor\" data-id=\"84e8485\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to the App, and will not be liable for any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty. Apple shall not be required to provide a refund to you or Customer under any circumstances.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-ab61972\" data-id=\"ab61972\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-f7fd426 elementor-section-boxed elementor-section-height-default elementor-section-height-default false\" data-id=\"f7fd426\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-d6c1868\" data-id=\"d6c1868\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-05d8ec4\" data-id=\"05d8ec4\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-91ca268 false elementor-widget elementor-widget-heading\" data-id=\"91ca268\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Term and termination<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-46cf61a elementor-widget elementor-widget-text-editor\" data-id=\"46cf61a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>PokerDealer may terminate access to the App at any time upon thirty (30) days&#8217; notice to Customer without cause if: (a) any third party (including Apple or your network connectivity provider) restricts, prevents, or ceases to authorize the installation or use of the App on your Supported Device or over your network; or (b) any of Customer\u2019s Users is using the App in a manner that is in violation of PokerDealer\u2019s Acceptable Use Policy. In addition, the iOS App Terms of Use shall terminate immediately and automatically upon the termination or expiration of Customer&#8217;s PokerDealer subscription for whatever reason. Upon any such termination or expiration, Customer and its Users will no longer be permitted to use the App, and will delete or destroy all copies of the App in its possession, including on all devices of its Users.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-90269af elementor-widget elementor-widget-text-editor\" data-id=\"90269af\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Termination of the iOS App Terms of Use shall not entitle Customer to any refund, credit, or other compensation from PokerDealer under the Agreement or any other agreement or from any third party.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-7823eb3\" data-id=\"7823eb3\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>The terms of use for the PokerDealer mobile application for iOS (\u201ciOS App Terms of Use\u201d) is a legally binding agreement.
